< Back Digital tools central for development of MSME trade in Latin America Mar 25, 2024 Digital tools and technologies play a crucial role in boosting trade for micro-, small-, and medium-sized enterprises (MSMEs) in Latin America, reveals a new ICC report. The “MSME Digital Exports in Argentina, Brazil, Colombia, and Mexico: Opportunities and Challenges,” is based on the results of a survey conducted in 2023 among more than 2,000 MSMEs in the region. It analyses the impact of the Covid-19 pandemic three years after its onset, identifies barriers to exports, and assesses the role of digital tools in enabling trade. With this report, ICC aims to contribute to discussions and initiatives in the region that seek to enhance the export capacity of MSMEs. Additionally, ICC aims to leverage the report to develop tailored training programmes for MSMEs in the region. “Digital technologies are creating opportunities for small businesses to trade and reach international markets. ICC is committed to providing the necessary resources to help local businesses harness these opportunities and benefit the communities they serve, in the region and beyond” said ICC Secretary General John W.H. Denton AO. Covid-19 pandemic: an inflection point The report shows that employment in MSMEs has yet to fully return to pre-pandemic levels, with 40% of surveyed MSMEs indicating a decrease in the number of employees since the beginning of the pandemic. Similarly, the pandemic significantly restricted their export capacity with many MSMEs, particularly in Brazil and Mexico, changing the destination of their exports. However, the Covid-19 pandemic triggered a significant increase in the use of digital tools and technologies with 80% of surveyed companies reporting an increase in the use of these tools. It also greatly accelerated the development of online commerce for both formal and informal MSMEs. Over 75% of the surveyed MSMEs in Argentina, Brazil, and Mexico began buying or selling products and services online during the pandemic. This trend was less pronounced in Colombia. Export barriers limit opportunities 70% of businesses surveyed in Argentina, Brazil, Colombia, and Mexico expressed an interest in exporting within Latin America, and 50% expressed an interest in exporting to North America. However, many barriers continue to hinder their ability to access international markets. The three main barriers that were reported are language, the lack of resources, and the regulatory environment. For micro-entrepreneurs, high competition levels and regulatory complexity are the most challenging hurdles. Digital tools: a key driver for the development of MSME exports Digital tools and technologies have become central to MSMEs’ ability to trade. Close to 80% of MSMEs surveyed in Argentina, Brazil, and Mexico claim to sell products online, and 63% of MSMEs in Colombia claim to do so. However, for many MSMEs, internet access remains too expensive, and many are dissatisfied with the quality of service, especially with the irregularity of the service, slow connection, and lack of technical support. Furthermore, the degree of familiarity with digital tools differs substantially between countries and business sizes. The main digital tools used to drive online sales are: WhatsApp, Mercado Libre, Instagram, Facebook Marketplace, and Amazon. However, MSMEs continue to face significant challenges linked to logistics, the regulatory environment, and payment systems. Finally, digital marketing is a key area of development for MSMEs – close to 70% of businesses are eager to receive training in digital marketing, while 50% are looking for training on how to identify market opportunities. < Back New chair of Global ICC Environment and Energy Commission announced ICC WBO May 15, 2024 ICC has announced the appointment of Rob Cameron, Global Head of ESG Engagement, Nestlé as the new Chair of the ICC Global Commission on Environment and Energy – a global forum of more than 500 members to shape policy discussions on the international sustainability agenda, including climate change and green economy. With over 25 years’ experience in the fields of sustainability and corporate responsibility, Mr Cameron joined Nestlé in January 2020 as Global Head of Public Affairs and was closely involved in the development of Nestlé’s Net Zero Climate Roadmap, its commitments on regenerative agriculture, and the development of the company’s Human Rights Roadmap and action plans. He is also the Secretary to the Sustainability Committee of Nestlé’s Board of Directors. Rob Cameron This is a key appointment for the ICC Commission on Environment and Energy as it continues to evolve its strong and unique offering to the international business community. With a mandate beginning 1 June 2024, Mr Cameron will be responsible for ensuring ICC’s leading role in leading international debate on the development of coherent policy frameworks, solutions and tools that enable and scale enhanced ambition – in line with the objectives of the Paris Agreement, the UN Convention on Biological Diversity and the UN Sustainable Development Goals. ICC Global Policy Director Andrew Wilson said: Mr Cameron has the experience, energy and vision that will be instrumental in leveraging ICC’s role in this strategic priority area. We are honoured that he has agreed to take on this important role and look forward to his leadership and support in accelerating sustainability and climate action. < Back ICC wins award for advancing inclusivity in arbitration Mar 22, 2024 ICC has been awarded the Equal Representation in Arbitration (ERA) Pledge Award for exceptional contributions to promoting diversity and inclusion. The announcement was made last night at the prestigious Global Arbitration Review (GAR) Awards ceremony in Paris. It is the second time ICC has been recognised in this category. The ERA Pledge Award acknowledges outstanding efforts in achieving gender diversity in international arbitration, recognising individuals, organisations, committees, or groups that have demonstrated remarkable dedication to enhancing gender representation within the field. This year, the ICC International Court of Arbitration was honoured for its groundbreaking work in advancing disability inclusion in arbitration and alternative dispute resolution (ADR) through the launch of a groundbreaking guide. Produced by the ICC Commission on Arbitration and ADR’s Task Force on Disability Inclusion in International Arbitration, co-chaired by Simon Maynard, Katherine Ramo and Todd Weiler, the ICC Guide for Disability Inclusion in International Arbitration and ADR provides clear guidance to address and accommodate the needs of people with disabilities participating in arbitral and ADR procedures, or other activities and events in the field of dispute prevention and resolution. Simon Maynard and Todd Weiler, emphasised the significance of this initiative saying the guide was an essential first step to placing disability on a level playing field with other protected characteristics. It allows practitioners to educate themselves about the meaning of disability and how it can intersect with the practice of arbitration. ICC first won the ERA Pledge Award in 2022 for establishing an LGBTQIA network and launching the Disability Task Force. Diversity and inclusion are core values of ICC, given their integral role in fostering peace, prosperity and opportunity for all. Other prestigious accolades at the 2024 GAR Awards included a Lifetime Achievement Award for Michael E. Schneider, founding partner of LALIVE and Senior Counsel for his unparalleled experience spanning over 40 years as counsel and international arbitrator. Michael E Schneider is a former vice chair of the ICC Commission on Arbitration, and has been a member of several of its working groups (1998 and 2009 revisions of the ICC rules, construction, pre-arbitral referee). < Back DSI Legal Reform Advisory Board announces new Chair ICC DSI Feb 2, 2024 The International Chamber of Commerce (ICC) Digital Standards Initiative (DSI) has announced the appointment of Oliver Wieck, Secretary General of ICC Germany, as the new Chair of the DSI Legal Reform Advisory Board. Mr Wieck is joined by three Vice-Chairs: Luca Castellani, legal officer of the United Nations Commission on International Trade Law (UNCITRAL) and one of the drafters of the Model Law on Electronic Transferrable Records; Vashti Maharaj, Head of Digital Trade Policy with the Commonwealth; and Chantal Ononaiwu, Trade Policy and Legal Specialist Office of Trade Negotiations from the Caribbean Community (CARICOM). ICC Executive Board member Valentina Mintah steps down from her role as Co-Chair having served on the Legal Reform Advisory Board since 2022. Since its inception in January 2022, the Legal Reform Advisory Board has played a pivotal role in the global campaign to remove legal barriers to seamless digital trade, and engage countries and policymakers in creating an enabling policy environment for digital trade to take root. John Denton, ICC Secretary General said: “The DSI Legal Reform Advisory Board leadership has a huge amount of expertise, and truly global reach, on the issue of legal reform. We look forward to supporting them in their advocacy work towards sustainable, inclusive, digital trade. The momentum is real, and 2024 will be pivotal.” The Legal Reform Advisory Board, which brings together a wide range of policy, legal, and financial expertise on trade digitalization, was instrumental in creating a monitoring framework to track global alignment to Model Law on Electronic Transferrable Records (MLETR). Mr Wieck, who has been serving as Interim Chair since September 2023, said: “As a representative of ICC’s national committees in the Legal Reform Advisory Board, I am very excited to contribute to shaping and promoting a globally comparable legal framework for the digitisation of global trade transactions.” Mr Castellani said: “I look forward to contributing to the work of ICC DSI on promoting the broader adoption of the UNCITRAL Model Law on Electronic Transferable Records, and, more generally, the digital transformation of trade. Arbitration & Dispute resolution Committee Discover the Commission's Key Initiatives ICC Netherlands Arbitration Committee The Dutch Arbitration Committee consists of all corporate, law firm and organizational members of ICC Netherlands who are interested in learning about and becoming more involved in ICC’s dispute resolution services in the Netherlands. The group meets in different parts of the Netherlands and abroad at luncheons, roundtable discussions, ICC arbitration conferences and via video or telephone conferences. The ICC Incoterms® 2020 The ICC "international commercial terms", known worldwide as the ICC Incoterms® rules, have been an internationally generally accepted set of definitions and terms of delivery for use in international and national purchase and sale agreements for goods with a global reach since 1936. The ICC Incoterms ® 2020 version is the most recent international standard on international trade and is therefore the modern alternative to the ICC Incoterms ® 2010 rules. Over the past 10 years, these have been crucial tools for importers, exporters, lawyers, carriers and insurers all over the world. ICC periodically reviews the rules. In addition to the experiences of users, changes in policies, environmental guidelines and new technology have been included in the adjustments. The ICC Incoterms ® 2020 provides buyers and sellers with an up-to-date framework. They are also easier to use. The Incoterms® rules consist of a set of three-letter delivery terms that reflect the customs between buyers and sellers of goods. These three-letter delivery terms describe the allocation of tasks, costs, and risks between buyers and sellers, saving time and protecting entrepreneurs from pitfalls and financial damage. Developed after extensive consultation with users including economists, lawyers, traders, freight forwarders, and banking and insurance experts from ICC's global network, the ICC Incoterms® 2020 rules reflect changes in international trade. The Drafting Group, established by ICC in 2016, included a mix of traders, business representatives, and trade law specialists who analysed over 3,000 substantial comments and conducted four consultation rounds with national offices and expert groups, including two physical expert consultations in Beijing and London. This thorough process ensures that the rules remain relevant and effective in the evolving landscape of global trade. What are the key changes in Incoterms® 2020? The Incoterms® 2020 address a demonstrated need in the market for on-board bills of lading under the Free Carrier (FCA) Incoterms® rule. Free Carrier (FCA) has been revised for Incoterms® 2020 to cater to a situation where goods are sold FCA for carriage by sea and buyer or seller (or either party’s bank) requests a bill of lading with an on-board notation. FCA in article A6/B6 now provides for the parties to agree that the buyer will instruct the carrier to issue an on-board bill of lading to the seller once the goods have been loaded on board, and for the seller then to tender the document to the buyer (often through the banks). < Back Enhanced consultation with taxpayers and increased tax certainty vital to future development of proposed UN Tax Convention ICC WBO Aug 19, 2024 Following a three-week intergovernmental meeting in New York earlier this month, the United Nations has adopted Terms of Reference for a Framework Convention on International Tax Cooperation – a potentially significant step towards establishing new rules for cross-border taxation. ICC, along with representatives from its national committees worldwide, actively participated in these negotiations – with the aim of ensuring that this initiative focuses on developing principles-based international tax policies that support trade, investment and the achievement of the Sustainable Development Goals (SDGs). Following the adoption of the Terms of Reference, John Connors, Chair of ICC’s Global Commission on Taxation said: “For companies globally, tax policy is not only a means of raising government revenues but also a catalyst for sustainable growth and development. It should drive investment in jobs, infrastructure, and technology, while fostering trade, encouraging sustainable investment, and ensuring fair competition. We look forward to a UN Convention that aligns with these critical objectives and are ready to constructively participate in the process”. Commenting on the details of the agreed text, Luisa Scarcella, ICC Global Policy Lead on Taxation, added: “While the inclusion of a new paragraph guaranteeing stakeholder participation in the future drafting of the UN Tax Framework Convention is welcomed, it is crucial to emphasise the need for structured, ongoing, and meaningful consultation with taxpayers throughout the drafting and negotiation process. “In this connection, we regret that an important amendment proposed by EU countries, based on a prior suggestion from India to include references to taxpayer safeguards, was not adopted. This is especially disappointing given that the importance of taxpayers’ safeguards and consultations is recognised domestically across the vast majority of UN member countries. “Additionally, while the inclusion of tax certainty as a guiding principle for the convention is appreciated, effective tax certainty requires broad international support and consistent implementation of new rules. Coordination with existing rules and frameworks established by other international forums is also essential. The business community hopes that the convention will be negotiated with broad consensus and that existing regulations will be duly considered. “We are also concerned by the decision to address the taxation of cross-border services in one of the two protocols to be negotiated simultaneously with the Framework Convention. The ambitious timeline for this process raises concerns about the need to carefully consider the economic impact of new rules on local economies and global trade, particularly for developing countries that are service exporters.” Previous Next

< Back ICC Forum seeks young regional representatives Arbitrage & ADR Feb 19, 2024 The ICC Young Arbitration and ADR Forum (ICC YAAF) has launched a campaign to recruit young practitioners in the field of dispute resolution and avoidance as new regional representatives for its 2024-2026 mandate. The new representatives will start their two-and-a-half-year mandate in June 2024. Current and new representatives will work concurrently until the ICC YAAF Global Conference on 27 September 2024. The conference, linked to the ICC New York Conference , will mark the official handover. Through regional event organisation and local initiatives, regional representatives play a pivotal role in ICC YAAF’s mission to connect young lawyers and in-house counsel to strengthen ties among younger international arbitration and ADR community members. Often hosted by a law firm, ICC YAAF events are dynamic and usually feature networking and social opportunities. As in past years, it is also possible to hold the events virtually and hybrid, to eliminate the burden of geographical frontiers and attract larger attendance. Dr Greg Lourie, currently Counsel at the ICC International Court of Arbitration, was ICC YAAF Representative for Europe and Central Asia from 2021 to 2022. Commenting on his mandate, he said: “Becoming an ICC YAAF Rep was a career-defining experience for me. It’s not just a position; it’s a gateway to a global community where your voice matters. Through YAAF, I gained invaluable skills, expanded my network, and opened doors to new opportunities.
